Title 14 § 91.215 ATC transponder and altitude reporting equipment and use.
According to FAA regulations, specifically 14 CFR § 91.215, an operable Mode C transponder with an encoding altimeter is required in the following airspace:
Class A airspace: From 18,000 feet MSL up to and including FL600. Class B airspace: Within and above all Class B airspace and within 30 nautical miles of the primary airport in Class B airspace, from the surface to 10,000 feet MSL. Class C airspace: Within and above all Class C airspace, from the surface to 10,000 feet MSL.
